Services

  1. We may offer to purchase from you any scrap gold or other precious metal.
  2. In using the Services, you warrant that:
  3. You are at least 18 years of age and are legally able to enter into a legally binding contract.
  4. You are resident in the UK.
  5. You have good title to the precious metals which you intend to sell.
  6. Such metal will be sold free from any liability or adverse claim of any type whatsoever and you are using the Services privately and in your personal capacity only and not using them for commercial or business purposes (whether directly or indirectly).
  7. All information which you submit to us is true and accurate.
  8. If the metal which you intend to sell to us is worth the aggregate amount of £1,000 or more, you agree that you will provide us with proof of identification as we may require this to satisfy our legal obligations.
  9. We reserve the right to request Proof of Purchase of items when selling to cashmygold.
  10. By using our service, you guarantee the following: that no items sold to us are the result of illegal activity in the UK or any other country; that any transaction initiated by the customer will not cause us to be in violation of any anti-money laundering, anti-terrorism, or other applicable law of any country.
  11. Once you have given acceptance of our offer the goods may be sent away to refiners and therefore your acceptance is legally binding and irrevocable.

Posting and Insurance

  1. All items sent to cashmygold must be sent using the Royal Mail Special Delivery provided to you by us. All items posted to us are at the customer's own risk until received and signed for by cashmygold. Until items are signed for by us all enquiries for claims or losses should be directed to Royal Mail. If you believe your items are worth more than £750, you must pay an additional fee at the Post Office to increase the insurance level to either £1,000 or £2,500. If we buy your items, we will refund this extra insurance you may have paid upon request. We may need to see your receipt from the Post Office before this refund can be processed, so please keep this receipt safe. If you decline our offer or if for any reason, we don’t make an offer to purchase the items you have sent to us, then no refund will be made against any extra insurance you may have taken out.
  2. You must fully complete and sign your valuation and declaration form and include it with your items. Cashmygold reserves the right to reject any forms (and the items they are sent with) which are not properly completed and signed. Cashmygold also reserves the right to reject delivery of any package which appears to be opened, damaged, or tampered with in any way. Any such packages we reject will be returned to you at our cost but without any liability to cashmygold.

Valuation Process

  1. Your items will be tested by making a scratch and placing acids on the items, or by using an XRF spectrometer. In addition, we may need to break your items to check if they are solid or simply wrapped in a precious metal. You accept that this process of determining a value and can leave permanent staining and damage to your items. You agree that we are not liable for any damage caused in this way or any resulting decrease in the value of the items.
  2. (Gemstones) we are not able to return any gemstones that are left in your items. If you wish to keep any gemstones, then please remove these before you send you items to us. Where our valuation team find a significant Gemstone, which has some intrinsic value, this will be considered when an offer is made to you.

How We Pay for Your Goods

  1. Following receipt of your pack, our valuation centre will conduct various tests and we will contact you with an offer to purchase your items or advise you that we will not make an offer. If we make an offer to purchase your items and following your acceptance and declaration of acceptance, we will make payment to you by way of Faster Payment directly to your UK bank account within 2 working days or by sending a cheque to the address detailed on your completed valuation form. Once you have accepted our offer, the goods can be immediately refined so your acceptance is legally binding on both you and us and it is irrevocable. Please note that when accepting an offer, any no value items will not be automatically returned.

Rejecting Our Offer & Returns

  1. If you decide not to accept our offer for your items your goods will be returned to you at our cost, via Royal Mail Special Delivery within five (5) working days from the date you declined our offer. However, if you send items containing no precious metals, there is a £25 processing fee for returning them to you, or if you choose, we can dispose of them free of charge. Your payment for returning items that contain no precious metals must be received within 28 days or the items will be disposed of.
  2. If returned items are not able to be delivered by Royal Mail because they have been unable to obtain a signature, they will leave an instruction card detailing how it can be collected or redelivered. If the package is returned to a local delivery office, it will need to be collected within a period specified by the Royal Mail. If however, the package is not collected within this time, it will be returned to us. On receipt of the returned items, we will contact you to arrange for the items to be resent; however, there will be a charge of £25 to cover the additional postage and administration costs.

Returns Loss Liabilities

  1. In the unlikely event that any of your items are lost once we have received them, we will pay you their replacement value, or provide items of a near equivalent value. If you are not happy with the near equivalent items we provide, we will jointly appoint, and jointly pay for, an independent valuer to assess them and we will both be bound by their judgment.

Indemnification

  1. You agree to indemnify us against all liabilities, claims, losses, costs, and fees which we incur as a result of any breach by you of these Terms and Conditions (including, but not limited to, claims brought by third parties).

Other Important Terms and Conditions

  1. We may transfer our rights and obligations under these Terms and Conditions to another organisation. We shall notify you in writing if this happens, any such transfer will not affect your rights or our obligations under these Terms and Conditions. This contract is between you and us, no other person shall have any rights to enforce any of its Terms.
  2. Each of the paragraphs of these Terms and Conditions operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs shall remain in full force and effect.
  3. These Terms and Conditions are governed by English and Scottish Law and the parties to them hereby submit to the exclusive jurisdiction of the courts of England and Wales in respect of any dispute or claim that arises out of or in connection with them. No failure or delay by us in exercising any right, power, privilege, or remedy available to us under these Terms and Conditions or in law shall constitute a waiver of that right, power, privilege, or remedy.

Complaints

We will always aim to provide an exceptional service. However, if at any time you become unhappy with our service, we are committed to resolving your complaint as quickly as possible. If you wish to make a complaint, please do so in writing by emailing office@cashmygold.org.uk

Data Protection

We take your rights to privacy very seriously. All personal information that we may collect, and hold will be collected, used, and held in accordance with the provisions of the Data Protection act 1998. For your part, you agree to the storing of this data for the provision of the services that we have agreed to undertake.
